although it's a bit weird here - who is getting kicked out? Den drabbade? In which case things change..."eller han borde ha vunnit kännedom om den" seems to me that 'den drabbade' is somehow guilty here, as the onus is on him to know about something. In which case I need to think about this more ;-).

i agree with you, it doesn't - but in Swedish the straight translation would be that. Context is strange
