"Rzadko spotykane zestawienie incurred or suffered by wynika ze składników długiego katalogu pzypadków objetych przejęciem odpowiedzialności i rekompensata. Te spośród nich które związane są z wydatkowaniem środkow pienięznych, np. expenses, fees, interest etc. łaczą się z czasownikiem incur czyli ponosić koszty, pokrywać koszty honorariów, odsetek etc., a te, ktore związane są ze zdarzeniami losowymi i niesprzyjającymi decyzjami np. losses, penalties etc. wiążą się z czasownikiem suffer. Ponieważ w języku polskim w obu przypadkach uzywa się czasownika ponieść koszt, stratę etc., fragment incurred or suffered by XXX nalezy odczytać jako: poniesione przez XXX"
A więc w związku z powyższym rozumiem tą fraze jako: suffers (loss) or incurs (costs as a result of) any analogous (bankruptcy/insolvency) proceedings
W Polsce wniosek o ogłoszenie upadłości, bo tym tu mowa, może wnieść do sądu zarówno dłużnik jak i wierzyciel. Sąd wniosek rozpatruje i go uznaje lub oddala.
