Source text - Arabic تشكل عملية تبييض الاموال هاجسا اساسيا أمام الدول التي تعمل على مكافحة هذا النوع من الجرائم المرتبطة بالإرهاب العالمي، وتسعى إلى عقد اتفاقات مع مجموعات متخصصة منتشرة في مختلف اصقاع الارض من أجل الحد من هذه الجرائم والسعي الى توقيف المتورطين بها.
الدولة اللبنانية كسائر الدول تتابع وتراقب حركة المجموعات التي تعمل على "تبييض الاموال" بطرق عدة، وهي ابرمت اتفاقات عدة تسهيلاً للأصول المتبعة في مكافحة هذه العمليات، وتسهيلاً للإجراءات التنفيذية المتبعة بهذا الخصوص، ومن بينها القانون الذي صدقه مجلس النواب عام 2015 والذي يتبنى التوصيات الصادرة عن مجموعة العمل المالي FATF وهي هيئة مستقلة متعددة الحكومات تضع وتعزز سياسات لحماية النظام المالي العالمي ضد غسل الأموال وتمويل الإرهاب ونشر أسلحة الدمار الشامل وفق ما يتم التعريف عنها.
تزامنا عمم مصرف لبنان قراره "الشهير" عام 2016 والمتعلق بأصول التعامل مع القانون الاميركي الصادر ومع انظمته التطبيقية حول منع ولوج "حزب االله" الى المؤسسات المالية الاجنبية وغيرها من المؤسسات، والذي تضمن الاصول والخطوات الواجب على المصارف اتخاذها تماشيا مع القرار الاميركي، ليأتي تعميم المصرف " مكملا" لقانون الدولة اللبنانية الصادر عام 2015 في مجلس النواب.
وهذا القانون يتحدث في مواده عن الاموال غير المشروعة، ويشرح ماهيتها ومن المقصود بها، كما يتناول عمليات تبييض الاموال ومن هي الجهات أو المجموعات التي تصنف تحت هذا العنوان.
ويتضمن القانون أيضا تعزيز صلاحيات الهيئة المستقلة ذات الطابع القضائي لدى مصرف لبنان وهي تتمتع بالشخصية المعنوية، وغير خاضعة في ممارسة اعمالها لسلطة المصرف وتسمى «هيئة التحقيق الخاصة» او «الهيئة»، مهمتها الاستقصاء والتحقيق في جرائم تبييض الاموال أو الاموال غير المشروعة ومحاسبة المرتكبين وفق ما ينص عليه القانون.
التكامل بين القانون الصادر عن مجلس النواب وتعميم مصرف لبنان يؤكد بحسب الامين العام للمؤتمر الدائم للفدرالية الدكتور الفرد رياشي أن الدولة اللبنانية وافقت على تصنيف حزب الله كتنظيم ارهابي لاسيما أن مصطلحات عدة يتضمنها "القانون والتعميم" تقودنا الى هذه النتيجة، ويذهب رياشي أبعد من ذلك ليؤكد أن القانون الذي صدق في مجلس النواب عام 2015 أي في مرحلة "الفراغ الرئاسي" كان بموافقة صريحة من الرئيس نبيه بري الذي كان على "دراية" بهذا الامر واستطاع أن "يمون" على نواب حزب الله للقبول به.
ينطلق رياشي في حديثه لـ "ليبانون ديبايت" ليؤكد أن ثمة فئة كبيرة وهي تتمثل بالطائفة المتماهية مع "حزب الله" متجهة لا محالة إلى دفع الثمن غالياً لأننا في دولة مركزية وقد وقعت على قانون مكتسب الشرعية الكاملة يدين تلك "الفئة"، وحيث مع تبدل الظروف السياسية سيكتسب النفاذ الكامل، في حين أن وجود الفدرالية "يجنب" هذه الفئة تداعيات قرار الدولة المركزية، التي تستضعف الطوائف حين تخرج من الحكم وتبطش بها.
وبرأي رياشي فان سلاح حزب الله هو نتيجة للمشكلة وليس سبباً لها، فلبنان دخل في حروب عدة عبر تاريخه ولم يكن الحزب موجودا قبل العام 1982 وبناء عليه فسبب المشكلة يعود الى النظام السياسي "الخاطئ" الذي لا يراعي التعددية، وفي وضعيتنا فإن نظام الدولة المركزية هو ما يتسبب بنشوء النزاعات والمشاكل الجوهرية وبقائها مستمرة، مشيرا الى اننا في مجتمع تعددي طوائفي في حين يتم حكمه عبر "نظام فاشل" فتأتي مجموعة طائفية واحدة لتفرض سيطرتها على السلطة المركزية وتغبن من لا يرضخ لها: "بدأنا من المارونية السياسية الى السنية السياسية واليوم الشيعية السياسية، ولن تنتهي دوامة الصراع العبثي والفساد ما دمنا لم نطبق الفدرالية التي وحدها قادرة على إخراج البلاد من التقوقع الطائفي عبر تأمين المساواة والحرية والعدالة والازدهار لكافة المكونات والمواطنين".
للحفاظ على التعايش طريق واحد علينا أن نسلكه بحسب رياشي وهو الانخراط في إرساء الدولة الفيدرالية كالتجربة السويسرية، ومن هذا المنطلق على حزب الله أن يدخل في حوار مع نفسه ومع المكونات الاخرى لكي لا يلقى مصير الطوائف الاخرى في البلد كما عليه ايجاد حل لسلاحه وفي الوقت نفسه الذهاب الى تسوية شاملة مع المكونات الاخرى من خلال النظام الفدرالي.
Translation - English Money laundering is a major concern for countries working to combat this type of crime which is linked to global terrorism. These countries are seeking to have agreements with specialized groups spread across the globe to curb these crimes and seek to arrest those involved.
The Lebanese state, like all other countries, monitors and follows up on the movement of groups working in money laundering in several ways. It has concluded several agreements to facilitate the measures used to combat these operations and to facilitate the executive procedures in this regard, including the law ratified by the Chamber of Deputies in 2015, which adopts the recommendations issued by the Financial Action Task Force (FATF), which is defined as an independent multi-government body that develops and promotes policies to protect the global financial system against money laundering, financing terrorism, and the proliferation of weapons of mass destruction.
In conjunction with that came the circular by Banque du Liban of its famous decision in 2016 on the measures of dealing with the US law and its implementing regulations on the prevention of Hizballah's access to foreign financial institutions and other institutions. The circular included the measures and the steps banks should take in line with the US decision. The circular of the Banque du Liban came as complementary to the law the Lebanese state issued in 2015 by the Chamber of Deputies.
This law speaks in its articles about illegal money, explains what it is and what it means, and deals with money laundering operations and who are the entities or groups that are classified under this label.
The law also includes the strengthening of the powers of the independent body -- which is of a judicial nature -- of Banque du Liban, which enjoys moral personality and is not subject to the authority of Banque du Liban. It is called the Special Investigation Commission or the Commission. Its task is to inspect and investigate money laundering or illegal money crimes, and to hold those who commit them accountable, as required by the law.
The complementation between the law issued by the Chamber of Deputies and the Banque du Liban's circular, confirms, according to Dr. Alfred Riachi, the Secretary General of the Continual Federal Congress, that the Lebanese state has agreed to classify Hizballah as a terrorist organization, especially since several terms included in law and the circular lead us to this result. Riachi goes further than that to confirm that the law, which was ratified in the Chamber of Deputies in 2015, in other words during "the presidential vacuum," was with the explicit approval of [parliament] Speaker Nabih Birri, who was aware of this matter and was able to make Hizballah's deputies accept it.
Riachi, during his talk with Lebanon Debate, confirms that a big category, represented by the community that approves of Hizballah, is going to pay a dear price because we are living in a centralized state. The state has signed a fully legitimized law which condemns this category. With the change of the political circumstances, the law will gain full enforceability. However, federalism, if present, would spare this category the repercussions of the decision of the central state which undermines the communities that come out of its authority and oppresses them.
In Riachi's view, Hizballah's weapon is the result of the problem and not a reason for it. Lebanon entered into several wars throughout its history. The party was not present before 1982, and consequently the problem is due to the "wrong" political system that does not take into account pluralism. In our situation, the system of the central government is the cause of the outbreak of conflicts and the essential problems and their continuity. He points out that we are in a multi-denominational society while being governed by a" failed system." A single denominational group comes to impose its control over central authority and oppresses those who do not bow to it. He says: "We started with the Maronite politics, then the Sunni politics, and today there is the Shiite politics, and the cycle of futile conflict and corruption will not end as long as we do not apply federalism, which is the only system that is able to get the country out of sectarian confinement by ensuring equality, freedom, justice, and prosperity for all components and citizens."
To maintain coexistence, there is one way to go, according to Riachi, which is to engage in the establishment of a federal state, such as the Swiss experience. In this sense, Hizballah should engage in dialogue with itself and other components so that it does not face the fate of the other communities in the country. It also has to find a solution for its weapon, and, at the same time, seek a comprehensive settlement with other components through the federal system.
