A PIACI KONCENTRÁCIÓ MEGELŐZÉSE
ÉS A JELENTŐS BEFOLYÁSOLÓ EREJŰ MÉDIASZOLGÁLTATÓK
A médiapiaci koncentráció megelőzésére vonatkozó általános szabályok
67. §
A lineáris médiaszolgáltatást nyújtó médiaszolgáltatók piaci koncentrációja a sokszínű médiapiac fenntartása, valamint a tájékoztatási monopólium létrejöttének megakadályozása céljából e törvény keretei között korlátozható.
68. §
(1) A legalább harmincöt százalékos éves átlagos közönségaránnyal rendelkező lineáris audiovizuális médiaszolgáltató, a lineáris rádiós médiaszolgáltató, valamint a lineáris audiovizuális és lineáris rádiós piacon együttesen legalább negyven százalékos éves átlagos közönségaránnyal rendelkező médiaszolgáltató, a médiaszolgáltató bármely tulajdonosa, és a médiaszolgáltató bármely tulajdonosában befolyásoló részesedéssel rendelkező személy vagy vállalkozás
a) új médiaszolgáltatást nem indíthat, médiaszolgáltatást végző vállalkozásban részesedést nem szerezhet, és
b) köteles médiaszolgáltatásai műsorstruktúrájának módosításával, a magyar műsorszámok, a független műsorkészítők által előállított műsorszámok arányának növelésével, vagy egyéb módon intézkedéseket tenni a médiapiac sokszínűségének növelése érdekében.
(2) Az (1) bekezdés a) pont esetében, amennyiben a médiapiaci koncentráció korlátozására vonatkozó szabály által érintett médiaszolgáltató médiaszolgáltatást végző vállalatban részesedést kíván szerezni, a Médiatanács a 171. § szerinti eljárásában a szakhatósági hozzájárulást köteles megtagadni.
(3) Az (1) bekezdés b) pont esetében a sokszínűség növelésére irányuló intézkedések meghatározása érdekében a médiaszolgáltató kérelmére a Médiatanács a médiaszolgáltatóval – legalább egyéves időtartamra szóló – hatósági szerződést köthet, amely eljárásban a Médiatanácsnak joga van mérlegelni a médiaszolgáltató által vállalni kívánt kötelezettségek elfogadását. Ilyen irányú kérelem a Médiatanács 70. § (7) bekezdésben meghatározott hatósági határozatának közlésétől számított harminc napon belül terjeszthető elő. Amennyiben a hatósági szerződés – a megegyezés elmaradása miatt – a 70. § (7) bekezdésben meghatározott hatósági határozat közlésétől számított három hónapon belül nem jön létre, akkor a Médiatanács az eljárást végzéssel megszünteti.
(4) A (3) bekezdésben meghatározott hatósági szerződés létrejöttének hiányában a Médiatanács 70. § (7) bekezdésben meghatározott hatósági határozatának közlésétől számított hat hónapon belül a médiaszolgáltató köteles a médiapiac sokszínűségének növelése érdekében tervezett intézkedéseinek jóváhagyása iránti kérelmet benyújtani. A Médiatanács a kérelem jóváhagyása iránti eljárásban azt vizsgálja, hogy a bejelentett intézkedések alkalmasak-e a korábbi tájékoztatási monopólium csökkentésére, a médiapiac sokszínűségének és a plurális tájékoztatás növelésére. E kötelezettség késedelmes teljesítése esetén a Médiatanács eljárási bírságot szab ki.
(5) Amennyiben a kérelem megfelel a (4) bekezdésben foglalt feltételeknek, azt a Médiatanács határozatával jóváhagyja.
(6) Kétség esetén a médiaszolgáltatót terheli annak bizonyítása, hogy a tervezett intézkedések megfelelnek a (4) bekezdésben foglalt feltételeknek.
(7) Amennyiben a Médiatanács a tervezett intézkedéseket nem hagyja jóvá, erről határozatot hoz, amelyben meghatározza, hogy azok miért nem megfelelőek a (4) bekezdésben foglalt elvek érvényesülése szempontjából.
(8) A (7) bekezdés szerinti esetben a médiaszolgáltató köteles a Médiatanács által megállapított határidőben, de legfeljebb harminc napon belül – a Médiatanács (7) bekezdésben szereplő határozatába foglalt szempontokat figyelembe véve – új intézkedéstervezetet benyújtani. E kötelezettség késedelmes teljesítése esetén a Médiatanács eljárási bírságot szab ki. Amennyiben ezen új kérelemben foglalt intézkedések sem megfelelők a (4) bekezdésben foglalt feltételek szempontjából, úgy a Médiatanács a 185-187. § szerint jogkövetkezményt alkalmazhat.
(9) A Médiatanács a határozatával jóváhagyott intézkedések teljesítését általános hatósági felügyelet keretében ellenőrzi.
(10) A lineáris audiovizuális és lineáris rádiós piacon együttesen elért éves átlagos közönségarányt az (1) bekezdés összefüggésében úgy kell meghatározni, hogy a lineáris audiovizuális és a lineáris rádiós piacon külön-külön elért éves átlagos közönségarány százalékban kifejezett mértékét össze kell adni.

PREVENTING MARKET CONCENTRATION AND MEDIA SERVICE PROVIDERS WITH SUBSTANTIAL MARKET INFLUENCE
General Rules on the Prevention of Media Market Concentration
Article 67
The market concentration of media service providers providing linear media services shall be prevented within the framework of this Act for the sake of maintaining the diversity of the media market and for preventing the formation of information monopolies.
Article 68
(1) Linear audiovisual media service providers, linear radio media service providers with an average annual audience share of at least thirty-five percent, and linear audiovisual and radio media service providers with a joint average annual audience share of at least forty percent, any owner of media service providers and any person or company with a controlling share in the media service provider’s owner
a) shall not launch new media services, shall not acquire shares in companies providing media services, and
b) shall take measures in order to increase the diversity of the media market by modifying the media service provision’s programme structure, by increasing the proportion of Hungarian productions and programmes prepared by independent producers, or by any other means.
(2) In the case presented under Paragraph (1) a), if the media service provider affected by the rule restricting media market concentration wishes to acquire a share in a company providing media services, the Media Council shall refuse the specialised authority authorisation in a procedure pursuant to Article 171.
(3) In the case presented under Paragraph (1) b), in order to determine the measures aimed at increasing diversity, the Media Council may conclude an administrative agreement — for a term of at least one year — with the media service provider upon the media service provider’s request, in which the Media Council shall be entitled to assess the acceptance of the obligations proposed by the media service provider. Such applications may be submitted within thirty days of the announcement of the Media Council’s administrative resolution as per Article 70 (7). If the administrative agreement — due to failure to reach an agreement — is not concluded within three months of announcement of the administrative resolution as per Article 70 (7), the Media Council shall terminate the procedure in a final decision.
(4) In the absence of the conclusion of an administrative agreement as per Paragraph (3), the media service provider shall submit its application for the approval of its measures aimed at increasing media market diversity within six months of the announcement of the Media Council’s administrative resolution as per Article 70 (7). In its approval procedure of the application, the Media Council shall evaluate whether the announced measures are suitable for decreasing the former information monopoly and for increasing media market diversity and pluralism. In the event of the late performance of such obligation, the Media Council shall impose a procedural fine.
(5) If the application complies with the conditions set out in Paragraph (4), the Media Council shall approve it in a resolution.
(6) In case of any doubt, it is the media service provider’s responsibility to prove that the proposed measures comply with the conditions set out in Paragraph (4).
(7) If the Media Council does not approve the proposed measures, it shall issue a pertaining resolution citing the reasons of non-compliance from the perspective of the principles set out in Paragraph (4).
(8) In the case presented under Paragraph (7), the media service provider shall submit a new plan for proposed measures by the deadline defined by the Media Council, but within thirty days at most, taking into account the aspects defined in Paragraph (7) of the Media Council’s resolution. In the event of late performance of such obligation, the Media Council shall impose a procedural fine. If the measures defined in the new application also fail to fulfil the criteria set out in Paragraph (4), the Media Council shall be entitled to apply the legal consequences defined under Articles 185-187.
(9) The Media Council shall monitor performance of the measures approved by its resolution in the context of general administrative supervision.
(10) The average annual audience share jointly reached on the linear audiovisual and linear radio market shall be determined for the purposes of Paragraph (1) by adding the individual average annual shares on the linear audiovisual and linear radio markets, expressed as a percentage.
